1. About these Terms. These Terms & Conditions apply when you use the ReThink Therapy / Uptrained Brain website, online learning platform, courses, programmes, memberships and digital resources. Please read them before purchasing or using our online services. By purchasing or enrolling in a course, programme or other paid service, you agree to the terms that apply to that purchase. 2. Programme-specific terms. Some courses, programmes, groups or services have their own Terms of Enrolment, client agreement or other specific terms. Where this applies, we will provide those terms before you purchase, enrol or begin the service. Those specific terms form part of your agreement with us. If there is a conflict between these general Terms and specific terms provided for a particular programme or service, the specific terms will apply to that service. 

If you are already taking part in a programme under Terms of Enrolment that you previously accepted, those existing terms continue to apply to that enrolment. These general Terms do not retrospectively replace them. If you receive individual therapy or psychological services from ReThink Therapy, your therapeutic work may also be covered by a separate client agreement or terms provided for that service.

 3. Our courses, programmes and resources. Uptrained Brain provides psychologically informed education, courses, programmes, resources and related services. The exact content, format, duration, level of access and any additional support included will be explained on the relevant course or programme page or in the specific terms provided before purchase. Please read this information carefully before enrolling. We aim to describe our services accurately and to provide them with reasonable care and skill. 

4. Psychological and wellbeing information. Our courses and resources may discuss psychology, mental health, wellbeing, behaviour, emotions, relationships and personal development. This information is provided for educational and personal-development purposes unless we specifically agree to provide an individual professional service to you. Participating in an Uptrained Brain course or using our resources does not, by itself, create a therapist-client relationship.

 General course material cannot take account of your individual circumstances and is not a substitute for individual medical, psychiatric, psychological or other professional advice where this is needed. If you have concerns about your mental or physical health, please seek appropriate individual professional advice. 

5. Not a crisis or emergency service. Our website, courses, online platform, email and community areas are not crisis or emergency services and should not be used to request urgent help. If you believe that you or another person is in immediate danger or requires urgent medical or mental-health assistance, please contact the appropriate emergency or urgent-care service. Do not rely on a message sent through a course, community area or email to obtain urgent assistance. 

6. Personal responsibility and sensitive material. Some of our material may invite you to think about personal experiences, emotions, relationships, behaviour or psychological wellbeing. You are responsible for deciding how and when you engage with course exercises and whether they are appropriate for you. You are generally free to pause an exercise or choose not to disclose personal information unless particular information is reasonably required to provide a service you have requested. 

Some material may bring up difficult thoughts, feelings or memories. If this happens, consider pausing and seeking appropriate support where needed. Please take particular care before sharing highly sensitive or clinical information through an online course, discussion area or community feature. How we handle personal and sensitive information is explained in our Privacy Policy. 

7. Accounts and access. You may need to create an account to access courses, programmes or resources. You are responsible for: providing accurate account information; keeping your login details secure; taking reasonable steps to prevent unauthorised access to your account; and telling us if you believe somebody else has gained access to your account. Unless we specifically say otherwise, access is provided to the person who enrolled or purchased the product. You must not share your login details or give another person access to paid material through your account. 

8. Zenler. We use Zenler to provide our online learning platform. Your use of our online learning environment may therefore depend on the availability and proper functioning of Zenler and other internet and technology services. We cannot guarantee that an online service will be available without interruption at all times. We will, however, take reasonable steps to deal with problems that are within our control. How personal information is handled when you use the platform is explained in our Privacy Policy. 

9. Prices and payment. The price of a course, programme or service will be shown before you purchase it. Where payment plans, deposits or instalments are available, the relevant payment arrangements will be explained before you agree to purchase. If a particular programme has its own payment, deposit, cancellation or refund terms, those programme-specific terms will apply. You are responsible for providing accurate payment and billing information. 

10. Your right to cancel. Your cancellation rights depend on what you have purchased and when delivery of the service or digital content begins. Where UK consumer law gives you a 14-day cancellation period, we will respect that right. For services, different rules may apply if you specifically ask us to begin providing the service during the cancellation period. Depending on the circumstances, you may have to pay for the part of the service already provided if you later cancel.

 For digital content supplied online, such as immediately accessible course materials, you may be asked to agree that access can begin during the 14-day cancellation period and to acknowledge the effect this has on your right to cancel. We will provide the relevant cancellation information before purchase where it applies. Nothing in these Terms removes or reduces any cancellation or other consumer right that the law gives you. 

11. Refunds. Any programme-specific refund arrangements will be explained before purchase where applicable. Nothing in our refund terms affects your legal rights if a service or digital product is faulty, not as described or has not been provided with the standard required by law. 12. Intellectual property. Unless we tell you otherwise, the courses, videos, recordings, written materials, exercises, worksheets, graphics, downloads, methods and other resources we provide are owned by us or used by us with permission. They are protected by copyright and other intellectual property rights. When you purchase or enrol in a course or programme, we give you permission to use the materials provided to you for your own personal use.

Unless we give you written permission, you must not: copy or reproduce our materials for other people; share paid materials with someone who has not purchased or enrolled; publish, distribute, sell or license our materials; upload substantial parts of our materials to another website or service; use our materials to create a competing course, product or service; remove copyright or ownership notices; or present our material as your own work. You may download or print resources where we have made them available for that purpose, but this does not transfer ownership of the material to you. 

13. Artificial intelligence and our materials. Unless we have given you written permission, you must not upload our paid or proprietary course materials, videos, transcripts, exercises, worksheets or other substantial programme content to an artificial-intelligence system for: training or developing an AI model; creating a dataset or knowledge base; analysing or reproducing substantial parts of our proprietary material; generating a competing or derivative course, programme or commercial product; or making our protected materials available to other people. 

This does not prevent reasonable personal use of AI tools with your own notes, ideas or reflections, provided you do not upload or reproduce our protected materials or another participant's confidential information. 

14. Group programmes, communities and confidentiality. Some programmes may include group sessions, discussions, communities or opportunities for participants to interact. We ask everyone taking part to respect the privacy of other participants. 

You must not, without the person's permission: record a group session or conversation; take or distribute screenshots containing another participant's personal information; share another participant's personal story or identifying information outside the group; or copy private messages or contributions and publish or distribute them elsewhere. 

Please remember that other participants are independent individuals. Although we can set expectations for group conduct and respond to concerns, we cannot guarantee another participant's behaviour or absolute confidentiality by other participants. We may remove content or restrict or end someone's participation where this is reasonably necessary to protect participants, maintain appropriate boundaries or respond to serious or repeated breaches of these Terms. 

15. Acceptable use. You must not use our website, platform or community areas: unlawfully; to threaten, harass or abuse another person; to impersonate another person; to deliberately introduce malicious software or interfere with the operation or security of the service; to gain unauthorised access to another person's account; to distribute another person's confidential or personal information without permission; or in a way that seriously disrupts a course, group or community for other participants. 

Where there is a serious or repeated breach, we may suspend or end access where this is reasonable and proportionate. Where appropriate, we will explain the reason and give you an opportunity to address the problem before access is ended, unless immediate action is reasonably necessary to protect another person, our systems or the integrity of the service. 

16. Changes to courses and services. We may occasionally need to make reasonable changes to course content, schedules, technology, facilitators or the way a service is delivered. For example, we may update material to improve it, correct an error, respond to changes in professional guidance or law, or deal with circumstances outside our reasonable control. 

We will not use this provision to make a significant change that leaves you with something substantially different from what you purchased without considering your rights and providing an appropriate remedy where required. If a programme has specific arrangements for changes or cancellation by us, those arrangements will be set out in its programme-specific terms. 

17. Third-party links and services. Our website and courses may contain links to websites, resources or services provided by other organisations. A link does not necessarily mean that we endorse everything on that website. We are not responsible for the content or availability of independent third-party websites or services. When you choose to use another organisation's service, its own terms and privacy information may apply. 

18. Our responsibility to you. We will provide our services with the level of care and skill required by law. Nothing in these Terms excludes or restricts liability where it would be unlawful to do so, and nothing in these Terms reduces your statutory consumer rights. We are not responsible for losses caused by events that we could not reasonably have foreseen or prevented. 

Our courses and resources are intended primarily for personal use. Unless we have specifically agreed otherwise with you, we are not responsible for business losses arising from their use. Nothing in these Terms excludes or limits responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other responsibility that cannot legally be excluded or limited. 

19. Privacy and data protection. We take the privacy of our users, clients and participants seriously. Our Privacy Policy explains: what personal information we collect; why we use it; how we handle sensitive and health-related information; the organisations that process information on our behalf, including Zenler and Zanda; how long we keep information; and your data protection rights. Please read our Privacy Policy alongside these Terms. 

20. Cookies. Our website and online learning platform may use cookies and similar technologies. Our Cookie Policy explains what these are and how they are used. 

21. Complaints and problems. If you are unhappy with a course, programme, purchase or service, please contact us so that we have an opportunity to understand the problem and try to resolve it.

If a particular professional service or programme has a separate complaints procedure, we will explain this where relevant. Nothing in this section prevents you from exercising any legal or regulatory right available to you.

 22. Changes to these Terms. We may update these Terms from time to time, for example because our services or the law change. The date at the top of this page shows when the Terms were last updated. Changes will normally apply to future use and future purchases. We will not use a later version of these general Terms to retrospectively remove contractual rights you already have under an existing purchase or programme agreement. Where a significant change needs to affect an ongoing service, we will provide appropriate information and consider any rights you have under the agreement and applicable law. 

23. If part of these Terms cannot be enforced If a court or other competent authority decides that part of these Terms cannot be enforced, the remaining terms will continue to apply. 

24. Governing law. These Terms are governed by the laws of England and Wales. If you are a consumer living elsewhere in the United Kingdom, you may also have rights under the law that applies where you live. Nothing in these Terms takes away any mandatory consumer protection that applies to you.
